[\/vc_column_text][vc_column_text]Based on the new General Data Protection Regulation (REGULATION (EU) 2016\/679 \u2013 \u201cGDPR\u201d), any\u00a0person responsible for<\/strong>\u00a0or\u00a0in charge of\u00a0<\/strong>the\u00a0processing<\/strong>\u00a0of\u00a0personal data<\/strong>\u00a0(SMEs, public organizations, NGOs, etc.) must comply with the GDPR.<\/p>\n

The\u00a0GDPR<\/strong>\u00a0is important because, among others:<\/p>\n

• It replaces the previous legislation, bringing all EU states under a\u00a0single legal framework<\/strong>;<\/li>\n
• increases<\/strong>\u00a0the level of\u00a0personal data\u00a0<\/strong>(PD)\u00a0protection<\/strong>\u00a0and\u00a0implies<\/strong>\u00a0a\u00a0greater commitment to PD\u00a0<\/strong>by companies or organisations:\n

  • In this sense, the\u00a0\u201cactive liability\u201d<\/strong>\u00a0is introduced: it is not enough to<\/strong>\u00a0react only when an infringement has occurred, but companies must\u00a0take\u00a0<\/strong>all\u00a0necessary measures\u00a0<\/strong>to\u00a0reasonably ensure<\/strong>\u00a0that they are able to\u00a0comply\u00a0<\/strong>with\u00a0the principles, rights and guarantees\u00a0<\/strong>of the\u00a0GDPR<\/strong>.<\/li>\n<\/ul>\n<\/li>\n
  • It applies<\/strong>\u00a0not only to data\u00a0controllers<\/strong>\u00a0and\u00a0processors<\/strong>\u00a0established in the EU,<\/strong>\u00a0but\u00a0also\u00a0<\/strong>to those\u00a0outside the EU if\u00a0<\/strong>the\u00a0processing\u00a0<\/strong>in question is\u00a0related\u00a0<\/strong>to:\n
    \n
    • Offers of goods and services<\/strong>\u00a0intended for EU citizens, or<\/li>\n
    • monitoring and follow-up<\/strong>\u00a0of their behaviour.<\/li>\n<\/ul>\n<\/li>\n
    • It broadens<\/strong>\u00a0the very\u00a0definition<\/strong>\u00a0of\u00a0\u201cpersonal data\u201d<\/strong>: it now covers any \u201cinformation about an identified or identifiable natural person\u201d (economic, cultural, health, etc.).\n
      \n
      • It can even affect the processing of data carried out using pseudonyms, when it is easy to identify who they belong to.<\/li>\n<\/ul>\n<\/li>\n
      • It introduces\u00a0new rights to improve the decision-making capacity and control<\/strong>\u00a0of EU citizens over their personal data, for example:\n
        \n
        • The\u00a0right to be forgotten<\/strong>: the data subject can request that links that lead to false, incomplete, irrelevant, obsolete information, etc., be blocked in a list of search engine results.<\/li>\n
        • The\u00a0right to portability<\/strong>: personal data already provided may be transferred to another person or company through a request for direct transmission or through its retrieval in a format that allows its transfer.<\/li>\n<\/ul>\n<\/li>\n
        • It strengthens\u00a0<\/strong>the general principle of the need for the\u00a0consent of the data subject for<\/strong>\u00a0any\u00a0processing<\/strong>\u00a0of personal data:\n
          \n
          • must be \u201cfree, specific, informed and unambiguous\u201d:\n
            \n
            • \u201cTacit consent\u201d is no longer accepted: a positive action or a statement expressing the approval of the person concerned is required.<\/li>\n
            • And the\u00a0consent<\/strong>\u00a0must be\u00a0explicit<\/strong>\u00a0in the case of\u00a0sensitive data.<\/strong><\/li>\n<\/ul>\n<\/li>\n
            • It establishes that\u00a0the data controller<\/strong>\u00a0is also\u00a0responsible\u00a0<\/strong>for\u00a0complying<\/strong>\u00a0with the provisions of the GDPR.<\/li>\n
            • It provides for severe fines for breaches of the obligations of the controller and the data processor, among others:\n
              \n
              • EUR 10 million or 2% of the overall total annual turnover<\/strong>\u00a0for failure to report possible breaches to the data protection authority.<\/li>\n
              • EUR 20 million or 4% of total annual global turnover<\/strong>\u00a0for any breach of the basic data-processing principles.<\/li>\n<\/ul>\n

                In both cases: \u201cwhichever is higher<\/strong>\u201d (art. 83)<\/em><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
